Hit by an Uninsured Driver? You Still Have Strong Options
Thousands of New York drivers operate vehicles without insurance every day. When one of them hits you, the situation feels hopeless — but it is not. New York law requires every auto insurance policy to include Uninsured Motorist (UM) coverage, which protects you precisely in this situation.
Our attorneys also pursue Underinsured Motorist (UIM) coverage when the at-fault driver has insurance but not enough to cover your damages. For qualifying cases where no other coverage exists, we explore the Motor Vehicle Accident Indemnification Corporation (MVAIC), a state fund designed to compensate innocent victims.
- Uninsured Motorist (UM) coverage in your own policy
- Underinsured Motorist (UIM) coverage for low-limit policies
- Motor Vehicle Accident Indemnification Corporation (MVAIC)
- Household vehicle policies that may cover you
- Pursuit of the uninsured driver's personal assets
UM/UIM Coverage
Understanding Your Uninsured Motorist Protection
Most New York drivers do not realize their auto policy includes UM coverage equal to their liability limits — typically $25,000 per person or higher. This coverage pays for your medical bills, lost wages, pain and suffering, and other damages when the at-fault driver has no insurance.
UIM coverage applies when the at-fault driver has insurance but not enough to cover your total damages. For example, if a driver with a $25,000 policy hits you and your damages total $150,000, we pursue the at-fault driver's $25,000 policy AND your UIM coverage for the remaining $125,000.
